1. Acceptance of Terms

By accessing or using ScamShield ("the Service"), operated by Obsidian Clad Labs LLC ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

ScamShield is an AI-powered scam detection tool that analyzes text, URLs, emails, and screenshots to identify potential scams and fraud. The Service provides scam scores, red flag analysis, and explanations. The Service also includes gamification features such as XP, levels, badges, and leaderboards.

3. Important Disclaimer

We strive for accuracy but cannot guarantee that every analysis will be correct. False positives (marking safe content as suspicious) and false negatives (missing actual scams) may occur. You should not rely solely on ScamShield for making financial or security decisions.

4. User Accounts

• •You must provide accurate and complete registration information
• •You are responsible for maintaining the security of your account credentials
• •You must be at least 13 years old to create an account
• •One person per account. Account sharing is not permitted
• •We reserve the right to suspend or terminate accounts that violate these terms

5. Acceptable Use

You agree NOT to:

• •Use the Service to create, distribute, or facilitate scams
• •Attempt to reverse-engineer our AI models or detection algorithms
• •Use automated tools to make bulk requests that exceed normal usage
• •Manipulate the gamification system (XP, badges, leaderboard) through fraudulent activity
• •Submit content that is illegal, harmful, or violates third-party rights
• •Interfere with or disrupt the Service or its infrastructure

6. Subscription Plans & Billing

• •Free plan: 5 scans per day, basic features, no payment required
• •Paid plans: Billed monthly or annually via Stripe
• •You may cancel your subscription at any time from your settings
• •Cancellation takes effect at the end of the current billing period
• •Refunds are available within 7 days of purchase for annual plans
• •We reserve the right to modify pricing with 30 days advance notice

7. Intellectual Property

ScamShield, including its name, logo, design, code, AI models, and content, is the intellectual property of Obsidian Clad Labs LLC. You may not copy, modify, distribute, or create derivative works without our written permission. Your scan results and account data remain yours.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OBSIDIAN CLAD LABS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR MONEY, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless Obsidian Clad Labs LLC from any claims, damages, or expenses arising from your use of the Service, violation of these terms, or infringement of any third-party rights.

10. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features with reasonable notice. We will provide at least 30 days notice before discontinuing the entire Service.

11. Governing Law

These Terms shall be governed by the laws of the State of New Mexico, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of New Mexico.

12. Changes to Terms

We may update these Terms from time to time. Significant changes will be communicated via email or in-app notification at least 14 days before taking effect. Continued use of the Service after changes constitutes acceptance.
